Following the installation of goods, equipment, or systems containing substances depleting the ozone layer or fluorinated greenhouse gases, these goods, equipment, or systems must be registered in the FOKA register through the e-Environmental Board services portal.
Included among the equipment requiring registration are:
- stationary refrigeration and air-conditioning equipment and heat pumps containing three or more kilograms of ozone depleting substances.
- stationary refrigeration and air-conditioning equipment and heat pumps containing five or more carbon dioxide equivalents of fluorinated greenhouse gases;
- stationary firefighting systems containing five or more carbon dioxide equivalents of fluorinated greenhouse gases;
- stationary equipment containing solvents based on fluorinated greenhouse gases containing five or more carbon dioxide equivalents of fluorinated greenhouse gases;
- stationary switchgear containing five or more carbon dioxide equivalents of fluorinated greenhouse gases.
The carbon dioxide equivalents contained in the equipment can be calculated using an online calculator.
The owner of the equipment has to register the equipment in the FOKA registry within 2 weeks as of the installation thereof.
The registration has two steps:
step I – the owner of the equipment submits information on the equipment and appoints a performer of handling operations (maintainer). If desired, the owner of the equipment authorises the maintainer to carry out step II;
step II – additional technical information on the equipment is submitted. Step II is either performed by the owner of the equipment or a maintainer authorised by him/her (the authorisation is granted in step I of the registration). NB! Grant of authorisation does not influence the obligations of the owner stemming from law and the owner is responsible for the timely submission of the information.
The selection of maintainer in the end of step I of the registration is carried out according to the scope of use of the equipment and to the type of substance contained in the equipment (ozone depleting substances or fluorinated greenhouse gases). There may be more than one maintainer of the equipment. For that, cells need to be added in the registration form.
An equipment is considered as registered if information of both steps has been submitted. Each registered equipment receives a unique FOKA registry code.
A label of the equipment containing fluorinated greenhouse gas with the FOKA registry code has to be glued close to the opening for servicing of the equipment. The label needs to be firmly affixed and clearly legible throughout the time period when the equipment contains fluorinated greenhouse gases.
NB! In the case on stationary refrigerating units, air conditioning machines and heat pumps, one refrigeration circuit is regarded as one equipment.
If the substance contained in different refrigerant circuits of the system is in direct mutual contact (through common pipeline), then one equipment needs to be registered in the FOKA registry and the amount of substances contained in all of the refrigeration circuits of the system must be summed up. If there is no such contact, then all of the circuits must be registered as separate equipment.
If the equipment has been registered in the FOKA registry and the maintainer of the equipment is changed or the information on the owner of the equipment or the location of the equipment is changed, then the owner of the equipment has to notify the Environmental Board by making a corresponding amendment in the registry within 10 working days. The technical information on the registered equipment (for example, amount of substance in the equipment, capacity of the equipment) cannot be amended by the owner of the equipment after confirming the registration. If the technical information has been marked incorrectly upon registration, one must address the Environmental Board to make an amendment.
Pursuant to the Ambient Air Protection Act, the owner of the equipment has to submit in the registry also information on the transfer, transfer of a usufruct or disposal from use and transfer to waste operators of the equipment within 2 weeks as of the corresponding operation.
If the maintainer of the equipment has registered reconstruction of the equipment, in the course of which the amount of substance contained in the equipment has been changed or the substance contained in the equipment has been replaced by some other substance (fluorinated gas), then a new equipment with new technical parameters is automatically created in the FOKA registry with a new marking. Pursuant to the Ambient Air Protection Act, the owner of the equipment has to complement the information on the new equipment and confirm the registration of the equipment within 2 weeks.
